Material Fact – Establishment of Administrative Process at Antitrust Authority – CADE
Tegma Gestão Logística S.A. (“Tegma” or “Company”), in compliance with the provisions of CVM Resolution No. 44/2021, informs its shareholders, investors and the market in general that, on today’s date, the Administrative Council for Economic Defense/Antitrust Authority (“CADE”) initiated an Administrative Process against Tegma and several other companies in the vehicle transport sector, due to the investigation initiated by the Operation that took place on 10/17/2019, communicated to the market on that date. This operation arises from a “Partial Leniency Agreement” signed by one of Tegma’s competing companies in the new vehicle transport market, based on an alleged concerted action in the “transportation of imported brand-new vehicles, especially for the client Kia, from the port to the Customs Station”.
After the initiation, the process will proceed with the presentation of defenses and evidentiary instruction, at the end of which we trust that the outcome of the process will be that of its archiving by CADE which, on another occasion, in the analysis of an Administrative Process initiated by a complaint from this same lenient competitor and others, already understood the lack of substance in the accusation of anti-competitive conduct.
